Luxair Gift Cards - Terms and Conditions

1.        General

 1.1.    These Terms and Conditions govern the relationship between you (also “customer”) and Luxair, Société Luxembourgeoise de Navigation Aérienne S.A., a public limited liability company (société anonyme) incorporated and existing under the laws of the Grand Duchy of Luxembourg, having its registered office at 25 rue Gabriel Lippmann, L-5365 Munsbach, with postal address at L-2987 Luxembourg, registered with the Luxembourg Trade and Companies Register under number B 4109 (further on “Luxair”).

1.2.   By purchasing and/or using the Gift Card, this evidences your full acceptance of these Terms and Conditions, which have been made available to you at the time of purchase and through the email which delivered the Gift Card, and also available on https://luxair.lu and https://luxairtours.lu or on our partner Cadooz’s website.

1.3.    No agent, employee or representative of Luxair has the authority to alter, modify or waive any of these Terms and Conditions.  

1.4.   The following terms shall have the meaning as defined hereunder, unless the context otherwise requires: 

a. “Gift Card” (also “gift card”) means the digital card with a prepaid balance card that can be redeemed towards (i) the purchase of flight-only tickets on the Luxair website https://luxair.lu or on Luxair Mobile App, or (ii) the purchase of travel packages, on the LuxairTours website https://luxairtours.lu, on Luxair Mobile App and in any partner travel agency.

b. “Date of issuance” means the date of the original issuance of the Gift Card. 

c. “Expiration date” means the last date on which customer can redeem its Gift Card. The Gift Card will expire on this date at end of the day: 23:59 UTC (Coordinated Universal Time).

d. ”Extra Services” means additional services selected by the customer with the purchase of a flight-only ticket or travel package, on the Luxair website https://luxair.lu or on LuxairTours website https://luxairtours.lu, on Luxair Mobile App or in any partner travel agency, excluding insurance.

e. “Voucher” means the Compensation Voucher and/or Residual Value Voucher offered by Luxair.

f. “Promotional Code” (or “Promocode”) means LuxairTours Promotional Ccode and Luxair Promotional Code.

g. “LuxairTours Promotional Code” means the code offered to the customer that can be used to receive a discounted price on the purchase of travel packages, on LuxairTours website https://luxairtours.lu, on Luxair Mobile App and in any partner travel agency.

h. “Luxair Promotional Code” means the code offered to the customer that can be used to receive a discounted price on the purchase of flight-only tickets on the Luxair website https://luxair.lu, on Luxair Mobile App and in any partner travel agency.

i. “Compensation Voucher” means the voucher offered in accordance with the Regulation (EC) No. 261/2004 and the rights of passengers in the event of flight delay or cancellation linked to a flight-only ticket, as detailed in Luxair Compensation Vouchers Terms and Conditions

 j. “Residual Value Voucher” means the digital voucher, as detailed in Luxair Residual Value Vouchers Terms and Conditions, sent to the customer for a flight-only ticket refund or a travel package refund in case the flight or the travel package is cancelled by Luxair or the customer, in accordance with the Terms and Conditions of the fare family of the purchased flight-only ticket(s) or the Luxair Tours General Terms and Conditions of Sale of the purchased travel package.  

k. “Miles&More” means the loyalty programme operated by the Lufthansa Group, which involves more than 200 partners worldwide (including roughly 40 airline partners, as well as 150 companies from the travel & mobility, entertainment & media, shopping, and finance sectors). The program allows travellers to earn and redeem Miles when flying with the airline partners.

l. “Miles” means the reward currency that members can earn and redeem through the Miles&More programme.

2.     Purchase

2.1.   Luxair Gift Cards are issued by our partner Qwikcilver Solutions Pvt. Ltd., and can be purchased on our website https://giftcards.luxair.lu, or directly from our partner Cadooz’s (“Cadooz”) website.    

2.2.   When purchasing a Gift Card from our website https://giftcards.luxair.lu, you may pay for the Gift Card by:

(i)  using the following credit cards: Visa, MasterCard and American Express, or;

(ii) converting your "Miles" balance available on your "Miles& More" loyalty account, in accordance with the specific conditions detailed in Article 3 of these Terms and Conditions.

Please note that when purchasing a Gift Card from Cadooz's website, alternative payment methods may be available at the time of your purchase.  

2.3.   You can order up to 10 Gift Cards in one and the same purchase. Each of the Gift Cards can be ordered for a specific minimum and maximum amount, which is mentioned on the Gift Card purchasing page. The minimum and maximum allowed amounts may vary depending on the type of the Gift Card.  

2.4.   The Gift Card can be purchased for anybody who has a valid email address. The Gift Card can be purchased for oneself.  

2.5.   Only when you purchase Gift Card from our website https://giftcards.luxair.lu, you can schedule the delivery of the Gift Card for up to 60 days before the delivery date. If you have selected “Delivery for later”, then the Gift Card will be delivered on the date you have selected.

2.6.   The Gift Card expiration date is mentioned in the email by which the Gift Card was delivered.  

2.7.    After making the purchase of the Gift Card, you will receive an order confirmation and payment confirmation in your email inbox.  

2.8.   The recipient of your Gift Card will receive in the email the Gift Card with the selected image and value. It will include the number of the Gift Card, the PIN code, and the link to the Terms and Conditions and to Luxair Security and Privacy Policy. The delivery of the email may take up to 24 hours.

3.      Conversion of Miles for purchase of Gift Card

3.1    Miles to Luxair Gift Card conversion is only available for online processing at https://Gift Cards.Luxair.lu/ 

3.2    All Miles&More members with sufficient miles value may avail the Miles conversion offering.  

3.3    In order to convert your Miles into a Gift Card, you must have at least 3,000 Miles available on the day of purchase of such Gift Card.

3.4   When converting Miles into a Gift Card, you must provide a valid email address as member-miles owner and a valid email address of your intended recipient, if applicable. The Luxair Gift Card will be sent to the recipient’s email address entered after transaction is completed. This email includes instructions on how to redeem the Gift Card. There will be no physical cards available. 

3.5    You will receive an order confirmation via email following the conversion of your Miles to a  Gift Card

3.6.  Gift Card cannot be reloaded. Other than the miles deducted from your Miles&More account, there are no other chargeable fees for your purchase and/or redemption of the Gift Card (e.g., activation fees, additional service fees, or dormancy fees, and the like).

3.7    Converted Miles cannot be returned to your Miles&Miles account. 

3.8   By using the system to convert your Miles into a Luxair Gift Card, you acknowledge and accept that additional terms and conditions may be applied by Miles&More, which may differ from our own. It is your responsibility to review and understand the terms and conditions of the Miles&More website before making a purchase.

3.9   Save as varied in this Article 3, all other provisions contained in these Terms and Conditions apply to the Gift Cards acquired by Miles conversion.

4.     Right of withdrawal

4.1. In accordance with the applicable consumer laws, where the agreement is for the delivery of digital content not stored on a physical data medium, the right of withdrawal expires if Luxair has begun performance of the agreement provided that (i) you have given your express prior consent for performance of the agreement to begin during the withdrawal period, (ii)  you have acknowledged that you will thereby lose your right of withdrawal; and (iii) we have provided a confirmation of purchase

4.2. Where the agreement is for the delivery of digital content not stored on a physical data medium, the right of withdrawal expires if Luxair has begun performance of the agreement after you have given your express consent to us prior to the expiry of the withdrawal period; and you have confirmed that you would lose your right of withdrawal from beginning of performance by giving your consent; and Luxair has provided a confirmation of the purchase agreement which contains the content of the agreement to you on a durable data medium.

5.      Terms of Usage

5.1.    The Gift Card is non-refundable. It cannot be paid out in cash, or transferred against value, under any circumstances. Further sale of Gift Card is likewise not permitted.  

5.2.    The Gift Card can be used multiple times, within the validity period, until the total balance of the Gift Card has been used completely. After the expiration date the Gift Card cannot be used, renewed or reactivated, nor can any unused remaining balance on the Gift Card be claimed or redeemed for cash. No refunds or credit note shall be issued for unused part of the Gift Card.  

5.3.   Gift card(s) cannot be redeemed for the purchase of further Gift Card(s).  

5.4.  Except where prohibited by law, Luxair reserves the right to refuse, deactivate, cancel, reject, or hold for review any Gift Card mistakenly issued in an incorrect denomination or issued or procured, directly or indirectly, in connection with fraudulent actions or in connection with any violation of these Terms and Conditions. 

6.       Redeem your Gift Card

6.1.    Gift Cards can only be used for (i) the purchase of flight-only tickets on the Luxair website https://luxair.lu or on Luxair Mobile App, or (ii) the purchase of travel packages, on the LuxairTours website https://luxairtours.lu, on Luxair Mobile App and in any partner travel agency. Holidays à la carte packages, Luxair City break packages or other stand-alone services available on the aforementioned websites cannot be booked with a Gift Card.  

6.2.    The Gift Card can be redeemed until its expiration date, which is mentioned in the email by which the Gift Card was delivered. The Gift Card expires on the mentioned expiration date at 23:59 UTC.  

6.3.    The flight must be completed at maximum 12 months after the expiration date of your Gift Card.  

6.4.   The Gift Card can be redeemed during the booking process, initiated either on https://luxair.lu, on https://luxairtours.lu, on the Luxair Mobile App or in partner travel agency. Before the payment page, you can enter the Gift Card number and PIN Code in the respective fields.  

6.5.   It is not possible to jointly redeem Promotional Code(s) together with a Gift card(s) or a Voucher(s) for the purchase of flight-only tickets and from Luxair websites https://luxair.lu, from Luxair Mobile App or from any partner travel agency.

It is possible to jointly redeem a single LuxairTours Promotional Code together with a Gift card or a Voucher for the purchase of travel packages from LuxairTours website https://luxairtours.lu, from Luxair Mobile App or from any partner travel agency.  

6.6.   The redemption of the Gift Card may be restricted for specific days, called blackout dates. If you have the departure or the arrival date on one of these dates, you will not be able to redeem your Gift Card for that specified period. This blackout dates can be verified in the Check balance section on https://giftcards.luxair.lu.

6.7.  Gift Card can be used for payment of additional travel insurance for travel packages booked from https://luxairtours.lu, from Luxair Mobile App or from any partner travel agency.

For flight-only tickets purchased from https://luxair.lu and on Luxair Mobile App, it is not possible to add Luxair’s travel insurance to your booking if you use your Gift Card for payment.

6.8.1    In case of purchase of a flight-only ticket, the Gift Card amount will be applied to the total flight fare (fare, taxes, and Extra Services if selected). When making a payment with the Gift Card, in case the booking amount is equal or exceeds the available credit, the Gift Card will be fully used. Therefore, the entire transaction payment should be made with the Gift Card or if the booking exceeds the Gift Card balance, the remaining amount must be paid with another accepted form of payment: credit card (Visa, MasterCard, and American Express) or other accepted Gift Card and Voucher. Payment with the Gift Card cannot be combined with PayPal payment. If there is any credit left after your transaction, the value of the Gift Card will be adjusted and will remain valid under the same conditions (no refund or extension possible).

6.8.2 In case of purchase of a travel package, the Gift Card amount will be applied to:

• the deposit if booking is made more than 30 days before departure. The total Gift Card amount will be used to cover the deposit.

• If the deposit amount is lower than the Gift Card amount, only the deposit amount will be withheld from the Gift Card.

• If the deposit amount is higher than the Gift Card amount, the full Gift Card amount will be used and the remaining payment will need to be made with Credit Card or PayPal.

• the total travel package price (fare and taxes, insurance, hotel and taxes, and Extra Services if selected).

When making a payment with the Gift Card, in case the booking amount is equal or exceeds the available credit, the Gift Card will be fully used. Therefore, the entire transaction payment should be made with the Gift Card or if the purchase exceeds the Gift Card balance, the remaining amount must be paid with another accepted form of payment: credit card (Visa, MasterCard, and American Express), Paypal or other accepted Gift Card(s) and Voucher(s).If there is any credit left after your transaction, the value of the Gift Card will be adjusted and will remain valid under the same conditions (no refund or extension possible).   

6.9    You can use up to three forms of payment for one purchase, combining Gift Card, Voucher and any accepted credit card.  

6.10   Any flight-only tickets paid totally or partially with Gift Card are non-refundable. In case the flight is cancelled by Luxair, or by the customer (in accordance with the Terms and Conditions of the fare family of the purchased ticket) a Residual Value Voucher will be issued.

6.11.1 Any travel package paid totally or partially with Gift Card are non-refundable. In case a travel package paid totally or partially with Gift Card is cancelled by Luxair, or by the customer (in accordance with the Luxair Tours General Terms and Conditions of Sale) the portion of the travel package paid with the Gift Card will be returned to you under the form of a Residual Value Voucher.

6.11.2 In case a travel package paid totally or partially with Gift Card is cancelled and is subject to payment of cancellation fees, you will receive a new Residual Value Voucher of the same value as the initial Gift Card used for the booking.

The cancellation fees shall be paid with another accepted form of payment: credit card (Visa, MasterCard, and American Express) or via bank transfer.

6.12. In the event that a booking is made in full or in part with a Gift Card, but the Gift Card has not been successfully applied, Luxair will contact you to finalise the payment. In case the payment is not successfully completed, Luxair reserves the right to cancel the booking.

7.       Liability and risk of loss

7.1.    The risk of loss and title for Gift Card pass to the purchaser upon our electronic transmission of the Gift Card to the purchaser or designated recipient.

7.2.    Luxair is not responsible if any Gift Card is lost, stolen, destroyed or used without recipient’s permission. You agree that the possession by any person of the Gift Card is deemed an authority for said person as bearer of the Gift Card to use the same. Neither Luxair nor Luxair’s agent, employee or representative is obligated to request a person presenting this Gift Card to identify himself/herself.

7.3.   Luxair does not accept any liability in the case that the email address of Gift Card recipient is misspelled.  

8.      Miscellaneous

8.1.   Luxair reserves the right to modify and otherwise change these Terms and Conditions at any time in its sole discretion. These modifications or changes shall not impact the Gift Cards that have already been purchased.

8.2.   These Terms and Conditions constitute the entire and only understanding between the Luxair and you, and replace any prior understandings or agreements (whether oral or written) relating to the subject matter hereof.

8.3.  The failure of Luxair to exercise any of its rights shall not be construed as a waiver or relinquishment of the future performance of any of its rights, and your obligations with respect to such future performance shall continue in full force and effect.  

8.4. If any clause contained in these Terms and Conditions becomes void, unenforceable or prohibited in any jurisdiction, this will not affect the validity and enforceability of the other clauses in these Terms and Conditions, or of these same clauses in other jurisdictions. In such cases, Luxair and you agree to replace the clause that is void, unenforceable or prohibited with a valid, enforceable clause in the spirit of the original.  

8.5.   These Terms and Conditions are drafted in English. If translated into a language other than English for any purpose, the English version shall prevail and be paramount in the event of any differences, questions or disputes concerning the meaning, form, validity, or interpretation of these Terms and Conditions.   

8.6.    These Terms and Conditions shall be governed by the laws of Luxembourg. To the extent permitted by law, you agree to submit to the exclusive jurisdiction of the courts of Luxembourg, for settlement of any dispute which might arise as a result of or in connection with these Terms and Conditions.  

8.7.     These Terms and Conditions shall be read in conjunction with our General Conditions of Carriage, Security and Privacy Policy, Cookie Policy,Terms of Use, the Compensation Vouchers Terms and Conditions, and the Residual Value Vouchers Terms and Conditions.

8.8. By making a purchase on Cadooz's website, you acknowledge and agree that additional terms and conditions may be applied by Cadooz, which may differ from our own. It is your responsibility to review and understand the terms and conditions of Cadooz's website before making any purchase.
